The Provider: 'The Wedding Jar'

The Customer: The person/s booking 'The Wedding Jar' for their event.

The following contract and its terms comprise an agreement between the Provider and the Customer for the hire of any services associated with The Wedding Jar.

Service Period

The Provider agrees to provide hired services and/or associated equipment in full operational condition for use for a minimum of 90% of the agreed service period. This will permit maintenance of the equipment should any be necessary. The service period does not include any allocated loading time. No discount is guaranteed following an interruption of services unless affected period is above 10% of the total service period.

Payment

A non-returnable deposit against the agreed charge is required to secure a reservation for the services and any event production services. The total balance of the agreed rental charge must be paid at any time before the Customer’s event. If a balance continues beyond the event, the Provider may add late payment charges at their discretion and may refuse to provide services. If the Customer uses the equipment for a period in excess of the agreed service period, additional rental charges will be payable by the Customer to the Provider, calculated on a pro rata basis. Overtime is charged at a base rate of £100ph but may be liable to change. Payment of all additional rental charges must be made by the Customer before any additional service period commences.

Access, space & power requirements

The Customer will arrange for an appropriate dry, flat and hard grounded space to be made available for the equipment at the event venue. A minimum floor area will depend on the services hired and should be discussed prior to the event. If the Provider feels it is unsafe to load, setup or provide the service hired, the provider is within their rights to refuse the service. The Customer will provide an appropriate electricity supply comprising of at least two 13amp sockets located within the space designated by the Customer for the DJ and associated services.

Parking/ Loading

There must be one designated parking space as well as appropriate access to the venue for loading and unloading of any equipment on hire. A number of factors may lead to additional charges and are not exclusive to, but may include costs such as congestion charging, parking fees and non-ground floor loading. These charges can be paid after the event, up to two weeks, depending on unforeseen or unknown circumstances. Loading and arrival times are estimated and may vary depending on traffic conditions or other unforeseen circumstances.

Date changes & cancellations

Any request to alter the agreed date must be made in writing and will be considered only if at least thirty days prior to the Customer’s event.

Any change of date is subject to the availability of the services or associated equipment for the alternative date and the receipt, by the Provider, of a new booking contract.

Loss or or damage to providers equipment

The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) whether caused by any misuse of the equipment by the Customer, their employees, their guests or any other party. The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by theft, fire, flood or accidental damage. Abusive or threatening behaviour will not be tolerated by members of staff and will result in immediate termination of any service with no reimbursement or notice required.

Staff, performance and act provisions

The Customer will arrange for an appropriate amount of food and drink for any DJs, musicians, acts or performers required 'on site' for longer than 4 hours. If no provision can be made please make us aware of this at least 48 hours before the event so other arrangements can be made. If no provisions are made, the Provider may charge for any additional costs incurred. It is the responsibility of The Customer to organise a hot meal for each staff member required on site for any evening booking of 4 hours or more. Arrangements should be discussed on a per-booking basis dependant on staff.

Indemnification

The Customer will indemnify the provider against any and all liability related to the customer’s event and use of the Provider’s equipment.

Miscellaneous terms

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.

In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational service or associated equipment for at least 90% of the agreed service period, the Provider shall make a refund to the customer calculated pro rata from the total charge made for the agreed service period. If no service is received, the Provider’s maximum liability will be the return of all relevant payments received from the Customer. The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement
